Family Files Claim Over Fatal ICE Shooting of Silverio Villegas González

A federal claim filed Thursday challenges the official account of an immigration agent killing Silverio Villegas González in Illinois. The 38-year-old was fatally shot in September 2025 during Operation Midway Blitz, an ICE enforcement surge that advocates say has left a trail of unaddressed violence and shredded families.

Video evidence has directly contradicted initial Department of Homeland Security reports, which claimed the victim refused orders and drove his vehicle at officers. Instead, the footage suggests an execution-style shooting that occurred shortly after Villegas González dropped his sons off at school. The family’s legal action, filed under the Federal Tort Claims Act, serves as a mandatory precursor to a potential lawsuit, aiming to force federal accountability that has been absent for over a year.

Mark Fleming of the National Immigrant Justice Center stated the filing is a necessary step to bring the truth to light. Meanwhile, the legal team representing the estate, including the MacArthur Justice Center, noted that the victim’s children were placed in foster care in Idaho following the incident. Efforts are currently underway by the victim’s brother, José Villegas González, to secure custody and adopt his nephews.

State-level oversight has stalled significantly. Illinois Governor JB Pritzker reported that the federal government has obstructed local investigators by withholding key evidence and refusing to make agents available for testimony. This standoff leaves the Illinois State Police Public Integrity Task Force unable to complete its probe. The case arrives amid broader scrutiny of federal immigration enforcement, following similar legal action taken last week by the family of Renee Good, who was killed by an ICE agent in Minnesota earlier this year.
